1. Acceptance of Terms

By accessing or using Verbalu (the “Service”), you confirm that you have read, understood and agree to be bound by these Terms of Use. If you do not agree, please do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these terms on its behalf.

2. Description of the Service

Verbalu provides web-based interactive tools, quizzes, games, boards and related features that teachers, trainers and organizations can use to run sessions with participants. We may add, change or remove features over time to improve the Service.

3. Accounts and Registration

Some features require an account. You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity that occurs under your account.

Participants may join certain sessions anonymously via a link or code without creating an account. You must notify us promptly of any unauthorized use of your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these terms. You may not misuse the Service, attempt to gain unauthorized access, disrupt its operation, or use it to distribute unlawful, harmful, infringing or offensive content.

You may not resell, sublicense or reverse-engineer the Service, nor use automated means to access it in a way that places an unreasonable load on our infrastructure.

5. Your Content

You retain ownership of the content you create or upload (quizzes, materials, responses and similar). You grant us a limited license to host, process and display that content solely to provide and operate the Service.

You are responsible for the content you create and for ensuring you have the rights necessary to use it. We may remove content that violates these terms or applicable law.

Verbalu does not review content before it is placed in the Service and is not responsible for content uploaded by users - in particular for content that is inappropriate, confidential, infringes third-party rights, contains personal data or trade secrets, or is otherwise unsuitable. The user remains the owner of uploaded content and is solely responsible for it, including its lawfulness, holding the rights required to share it, and the consequences of placing it in the Service and making it available to others.

6. Intellectual Property

The Service, including its software, design, trademarks and built-in content, is owned by Verbalu or its licensors and is protected by law. Except for the rights expressly granted to you, no rights are transferred to you.

7. Subscriptions and Payments

Some features are offered free of charge, while others may require a paid subscription. Pricing and the scope of paid plans are described at the point of purchase or in a separate agreement.

Unless stated otherwise, fees are non-refundable except where required by law. We may change pricing for future billing periods with reasonable prior notice.

8. Availability and Changes

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, update or discontinue features, and we will try to limit any disruption.

9. Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. We do not warrant that the Service will meet your specific requirements.

To the maximum extent permitted by law, Verbalu shall not be liable for indirect, incidental or consequential damages arising from your use of the Service. Nothing in these terms limits liability that cannot be limited by law.

10. Suspension and Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these terms or use the Service in a way that may cause harm to us or other users.

11. Changes to These Terms

We may update these Terms of Use from time to time. We will post the updated version with a new “last updated” date and, where required, notify you. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.

12. Governing Law

These Terms of Use are governed by the laws of Poland, without regard to conflict-of-law rules. Any disputes will be subject to the jurisdiction of the competent courts in Poland, unless mandatory consumer-protection law provides otherwise.
